Terms of use

Effective October 22, 2026

These terms of use (“Terms”) govern your use of hamerdon.com (the “site”), operated by Hamerdon Metals LLC, a Delaware limited liability company based in Arlington, Virginia (“Hamerdon,” “we,” “us” or “our”). By using the site or submitting an enquiry, you agree to these Terms. If you do not agree, do not use the site.

Our collection and use of personal information is described in our privacy policy.

1. Who may use the site

The site is intended for businesses and their representatives in the United States. You must be at least 18 years old to use it. If you use the site or submit an enquiry on behalf of a company or other organization, you confirm that you are authorized to do so, and “you” includes that organization.

2. No offer; transactions

Content on the site, including descriptions of accepted materials, supply capabilities and documentation, is general information. It is not an offer to buy or sell, a price quotation, or a commitment to supply or purchase any material. Availability, specifications, prices and terms are confirmed only in writing for each transaction.

Submitting an enquiry does not create a contract or any obligation for either party. Any purchase or sale of material is governed solely by a separate written agreement, purchase order or terms of sale accepted in writing by Hamerdon, which will control over these Terms for that transaction. Hamerdon may decline any enquiry or transaction at its discretion, including after supplier qualification, sampling or analysis.

3. Compliance information

The site summarizes laws and contract clauses such as 10 U.S.C. 4872 and DFARS 252.225-7052 for general information only. These summaries are not legal advice, may not reflect later changes, and do not address your specific circumstances. Confirm requirements against the applicable statutes, regulations and contract clauses, and consult your own counsel.

Origin, chain-of-custody and analysis documentation that Hamerdon provides is intended to support a customer’s own compliance review. It is not a government certification, and each customer remains responsible for its own compliance determinations and representations to its customers and to the government. Any warranty or representation about material or documentation applies only as stated in the written agreement for that transaction.

4. Enquiries and submissions

When you submit an enquiry or other information, you confirm that it is accurate and complete to the best of your knowledge, that you have the right to provide it, and that any material you offer is lawfully owned by you or your organization and is described truthfully, including its origin.

Please do not send confidential or proprietary information through the site. Information submitted through the site is not treated as confidential unless we have agreed otherwise in writing. If you send us suggestions or feedback about the site or our services, we may use them without any obligation to you.

5. Acceptable use

You agree not to:

We may suspend or block access to the site for anyone who violates these Terms.

6. Export controls and sanctions

Tungsten materials, products and related technical information may be subject to U.S. export control and economic sanctions laws, including the Export Administration Regulations and regulations administered by the Office of Foreign Assets Control. You may not use the site, or engage in any transaction with Hamerdon, if you are located in, or organized under the laws of, a country or region subject to comprehensive U.S. sanctions, or if you are named on, or owned or controlled by a party named on, a U.S. government restricted-party list. Hamerdon screens counterparties and may decline or stop any enquiry or transaction to comply with these laws. Hamerdon does not source material from China, Russia, North Korea or Iran.

7. Intellectual property

The site and its content, including text, graphics, logos and design, are owned by Hamerdon or its licensors and are protected by intellectual property laws. “Hamerdon” and the Hamerdon logo are trademarks of Hamerdon Metals LLC. You may view and print pages of the site for your internal business use in evaluating a relationship with Hamerdon. You may not otherwise copy, modify, distribute, or create derivative works from the site, or use our name or logo, without our written permission. Photographs on the site are used under license from their respective owners.

The site may link to websites operated by others, such as government and regulatory sources. We do not control and are not responsible for their content, accuracy or practices, and a link is not an endorsement.

9. Disclaimer of warranties

The site and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and availability. We do not warrant that the site will be uninterrupted, error-free or free of harmful components, or that information on the site is complete or current.

10. Limitation of liability

To the fullest extent permitted by law, Hamerdon and its members, managers, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, data or goodwill, arising out of or relating to the site or these Terms, even if advised of the possibility of such damages. Our total liability arising out of or relating to the site or these Terms will not exceed one hundred U.S. dollars (US$100).

This section does not limit liability that cannot be limited under applicable law, and does not apply to any transaction governed by a separate written agreement, which sets out its own terms. Some states do not allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Hamerdon and its members, managers, officers, employees and agents from any claims, losses, liabilities and expenses, including reasonable attorneys’ fees, arising out of your violation of these Terms, your misuse of the site, or information you submit, including any misrepresentation of the origin or ownership of material.

12. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Virginia and applicable U.S. federal law, without regard to conflict of laws rules. Any dispute arising out of or relating to the site or these Terms will be brought exclusively in the state courts located in Arlington County, Virginia, or the United States District Court for the Eastern District of Virginia, Alexandria Division, and you and Hamerdon consent to the personal jurisdiction of those courts.

13. Changes and availability

We may change these Terms by posting an updated version on the site with a new effective date. Changes apply to use of the site after they are posted. We may change, suspend or discontinue any part of the site at any time without notice.

14. General

These Terms, together with the privacy policy, are the entire agreement between you and Hamerdon about the site. If any provision is found unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition or sale of assets. Sections 3, 4, 7 and 9 through 14 survive any termination of your use of the site. You agree that we may communicate with you electronically, and that electronic communications satisfy any requirement that a communication be in writing.
